Regulamin skupu smartfonów i telefonów HAMMER
§ 1 Definitions
1. Skup smartfonów i telefonów („Skup”) – program organizowany przez Moby.pl sp. z o.o. (KRS: 0000435984) we współpracy z mPTech Sp. z o.o. (KRS: 0000243245) polegający na umożliwieniu Klientom sprzedaży używanych urządzeń marki HAMMER oraz innych marek na warunkach określonych w Regulaminie.
2. Strona internetowa („Strona”) – podstrona strony internetowej https://www.hammerphones.com o adresie: https://www.hammerphones.com/skup-telefonow, na której opublikowane są informacje o Skupie, w tym Regulamin oraz Formularz Skupu.
3. Klient – użytkownik Strony dokonujący Zgłoszenia, będący osobą fizyczną, dokonujący czynności prawnej niezwiązanej bezpośrednio z jego działalnością gospodarczą lub zawodową.
Partner – Moby.pl sp. z o.o. based in Wrocław at ul. Jana Długosza 68, 51-162 Wrocław, registered in the register of the District Court for Wrocław-Fabryczna, VI Economic Department KRS: 0000435984, with a share capital of: 5,000 PLN, REGON: 021986625, NIP: 898-220-16-48; the entity purchasing the Device from the Client as part of the Buyback.
Organizer – mPTech Sp. z o. o. based in Warsaw at ul. Nowogrodzka 31, 00-511 Warsaw, registered in the Register of Entrepreneurs of the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, XII Economic Division – National Court Register under the number KRS 0000243245, NIP: 8951845043, REGON: 020167256.
6. Urządzenie – używany smartfon lub telefon marki HAMMER, nie starsze niż 5 lat (decyduje data produkcji urządzenia) liczone od daty wysłania formularza skupu przez Klienta, będący własnością Klienta.
7. Formularz Skupu („Formularz”) – formularz internetowy dostępny na stronie https://www.hammerphones.com/phone-buyback, który Klient wypełnia w celu skorzystania z programu Skupu. Składa się z ankiety, na podstawie której ustalana jest Wstępna wycena oraz z danych osobowych Klienta niezbędnych do realizacji Zgłoszenia i zawarcia umowy sprzedaży.
8. Wstępna wycena – ustalona wstępnie przez Klienta za pomocą Formularza wartość Urządzenia, oszacowana na podstawie cennika Organizatora, która pozwala na złożenie przez Klienta Organizatorowi poprzez Zgłoszenie zaproszenia do złożenia oferty sprzedaży.
9. Wycena ostateczna – wartość zgłoszonego Urządzenia ustalona przez Organizatora po przetestowaniu Urządzenia otrzymanego od Klienta. Przedstawienie Klientowi Wyceny ostatecznej stanowi ofertę w rozumieniu przepisów kodeksu cywilnego.
10. Umowa Sprzedaży – umowa sprzedaży Urządzenia, w ramach której sprzedawcą jest Klient, a kupującym jest Organizator.
11. Zgłoszenie – złożenie przez Klienta Organizatorowi zaproszenia do złożenia oferty sprzedaży Urządzenia za pośrednictwem Formularza znajdującego się na Stronie Partnera lub Organizatora.
12. Kod SMS – kod wygenerowany przez Klienta w celu zatwierdzenia i przesłania Zgłoszenia.
13. Kod rabatowy - unikalny kod na zakupy w sklepie: https://www.hammerphones.com, o wartości -10% całego koszyka, którego maksymalna wartość wynosić może 4000 zł (słownie: cztery tysiące) wysłany Klientowi przez Partnera po zrealizowaniu skupu, do jednokrotnego wykorzystania, ważny 1 rok od jego wygenerowania. W koszyku zakupowym mogą znajdować się maksymalnie trzy produkty. Rabat obejmuje cały asortyment z wyłączeniem produktów HAMMER WEAR oraz produktów przecenionych. Kod rabatowy nie łączy się z innymi promocjami na stronie sklepu, nie obejmuje kosztów dostawy oraz nie może być wykorzystany częściowo, nie podlega wymianie na gotówkę oraz nie podlega odsprzedaży.
§ 2 General Provisions
1. Niniejszy regulamin określa tryb i zasady funkcjonowania oraz korzystania z Formularza znajdującego się pod adresem: https://www.hammerphones.com/phone-buyback, a także ogólne warunki Umów sprzedaży zawieranych w ramach Skupu.
2. Skup obowiązuje od 19.10.2026 r. do odwołania.
3. Skup organizowany jest przez Moby.pl sp. z o.o. we współpracy z Partnerem i jest dostępny dla Klientów w tym Klientów Partnera.
All actions taken by the Client within the framework of the Purchase should be in accordance with applicable laws and good customs.
5. Stroną każdej Umowy sprzedaży zawartej wskutek wypełnienia przez Klienta Formularza na https://www.hammerphones.com/phone-buyback i późniejszego zaakceptowania przez Klienta Wyceny ostatecznej jest Organizator, tj. Moby.pl sp. z o.o. z siedzibą we Wrocławiu przy ul. Jana Długosza 68, 51-162 Wrocław, wpisaną do rejestru Sądu Rejonowego dla Wrocław-Fabryczna, VI Wydział Gospodarczy KRS: 0000435984, o kapitale zakładowym: 5 000 zł, REGON: 021986625, NIP: 898-220-16-48.
Using the Site allows Customers to submit an invitation to make an offer to sell the Device at the estimated price within the Preliminary valuation.
7. Przystępując do Umowy z Partnerem, Klient ma możliwość zapoznania się z Regulaminem i Polityką Prywatności na Stronie. Klient akceptuje ich treść poprzez zaznaczenie odpowiedniego pola w Formularzu. Do realizacji Zgłoszenia konieczna jest akceptacja postanowień Regulaminu i Polityki Prywatności.
The Client, by submitting the Application via the Form, is obliged to comply with these Regulations to the extent necessary for the implementation of the Application and that does not conflict with applicable law and the principles of social coexistence.
§ 3 Conditions for Participation in the Purchase
As part of the Buyback, a Customer who owns a Device and meets the conditions for participating in the Buyback, as specified in § 3 sec. 2 of the Regulations, may sell it to the Partner after completing the Form.
2. Klientem może być:
a physical person performing a legal act not directly related to his or her business or professional activity,
2. posiada pełną zdolność do czynności prawnych oraz
has a place of residence in the territory of the Republic of Poland.
3. Klient oświadcza, że podane w Formularzu dane są danymi rzeczywistymi, a sprzedawane Urządzenie jest jego własnością.
The condition for processing the Application in order to present the Client with an offer to conclude a sales agreement for the Device is the completion and submission of the Form by the Client. Submitting the Form and subsequently concluding the sales agreement is voluntary.
Before submitting the Application, the Client is required to read and submit a statement of acceptance of the provisions of this Regulation, as specified in § 2 sec. 7.
6. Przesyłając Zgłoszenie Klient oświadcza, iż wyraża zgodę na otrzymywanie od Organizatora i /lub Partnera na wskazany przy wypełnianiu Formularza adres e-mail komunikatów dotyczących realizacji Zgłoszenia oraz otrzymania kodu rabatowego, o którym mowa w § 1 ust.13.
7. Organizator zastrzega sobie prawo do natychmiastowego wykluczenia Klienta z udziału w Skupie w przypadku uzasadnionego podejrzenia, że dany Klient narusza w jakikolwiek sposób postanowienia niniejszego Regulaminu lub powszechnie obowiązujące przepisy prawa, lub w jakikolwiek inny sposób zostanie poddana w wątpliwość wiarygodność i uczciwość Klienta w związku z programem skupu.
8. Organizator zastrzega sobie prawo do odmowy przyjęcia Urządzenia do programu skupu w przypadkach określonych w Regulaminie, w tym gdy Urządzenie nie spełnia warunków skupu lub istnieją uzasadnione wątpliwości co do jego pochodzenia albo nie odpowiada opisowi podanemu przez Klienta.
§ 4 Procedure for the Conclusion and Execution of the Sales Agreement
1. Klienci za pośrednictwem https://www.hammerphones.com/phone-buyback mogą składać Formularze stanowiące zaproszenie do złożenia przez Organizatora oferty zawarcia Umowy Sprzedaży Urządzenia.
2. Użytkownik podczas wypełniania Formularza może zgłosić do Skupu tylko jedno Urządzenie, przy czym w przypadku chęci sprzedaży większej liczby Urządzeń, klient może wypełnić kolejne Formularze. Kod rabatowy udzielany jest do każdego zgłoszenia.
The territorial scope of the sales agreement pertains only to the territory of the Republic of Poland.
To begin the process of entering into the Agreement, the Client should:
1. wybrać model Urządzenia poprzez wyszukiwarkę zamieszczoną na https://www.hammerphones.com/phone-buyback,
2. wypełnić Formularz wraz ze Wstępną Wyceną,
to submit the Form and thereby extend an invitation to submit a sales offer.
5. Przy każdym modelu Urządzenia, po uprzednim wyborze go przez Klienta poprzez wyszukiwarkę znajdującą się na stronie https://www.hammerphones.com/phone-buyback oraz wypełnieniu ankiety zawartej w Formularzu umożliwiającą przedstawienie Wstępnej Wyceny, podana jest kwota stanowiąca przewidywaną cenę za daną markę i model telefonu pod warunkiem pozytywnej weryfikacji jego stanu przez Organizatora. Wstępna wycena nie stanowi oferty w rozumieniu Kodeksu cywilnego.
If the Preliminary Valuation is rejected, all actions taken by the User up to that point are considered null and void.
7. Jeżeli Klient po zapoznaniu się ze Wstępną Wyceną decyduje się złożyć Organizatorowi zaproszenie do zawarcia Umowy Sprzedaży, wybiera opcję „Zamów kuriera”. Po dokonaniu tej czynności Klient otrzyma na swój adres e-mail informację potwierdzającą przyjęcie Zgłoszenia przez Organizatora. Klient w tej samej wiadomości e-mail otrzymuje podsumowanie swojego Zgłoszenia wraz ze Wstępną Wyceną oraz link do formularza DHL umożliwiający mu zamówienie kuriera celem wysyłki Urządzenia do Organizatora oraz etykietą do umieszczenia na wysyłanej przesyłce.
The Client is obligated to send the Device within 14 days. The Client must hand over the Device to the courier on the date previously agreed upon via the DHL form. If the Client does not hand over the Device to the Courier before the 14 days expire, all previous actions and agreements between both parties shall be considered null and void. The delivery of the Device by the Client should be carried out in accordance with the information received via email, as well as in accordance with § 7 of these Regulations. A detailed instruction on how to prepare the phone for shipping is also available on the website:
9. Organizator po otrzymaniu Urządzenia, w ciągu 30 dni od otrzymania Urządzenia od kuriera, dokona jego weryfikacji w celu sprawdzenia, czy spełnia on warunki określone w § 5 ust. 8 oraz dokona Ostatecznej Wyceny Urządzenia, przekazując informację o zawarciu umowy sprzedaży Partnerowi.
The Organizer will inform the Client via email about the verification result and the Final Valuation, and will request its acceptance as well as the provision of the bank account number for the payment for the Device.
In order to accept the offer for the sale of the Device under the terms specified in this regulation and at the price determined by the Final Valuation, the Client informs the Organizer via email that they accept the Final Valuation by responding to the email from the Organizer mentioned in section 10 above, along with providing their bank account number.
12. W przypadku akceptacji przez Klienta oferty sprzedaży zgodnie z ust. 11 powyżej Organizator dokona zapłaty za Urządzenie poprzez przelew na rachunek bankowy wskazany przez Klienta w wiadomości e-mailowej, w kwocie Wyceny Ostatecznej zaakceptowanej przez Klienta. Przelew bankowy może być zrealizowany tylko na konto bankowe podane przez Klienta w momencie przesłania wiadomości e-mail do Organizatora. Organizator nie może w żadnym wypadku wycofać lub ponowne zlecić płatności przelewem bankowym, jeżeli został on już wykonany.
13. Wraz z dokonaniem zapłaty przez Organizatora na rzecz Klienta umowę sprzedaży uznaje się za zawartą. Za datę zapłaty przyjmuje się chwilę zlecenia przelewu ceny.
14. Po zawarciu umowy sprzedaży Klient dodatkowo w podziękowaniu za udział w Skupie otrzyma od Organizatora drogą e-mailową unikalny kod rabatowy.
The lack of acceptance by the Client of the Final Valuation within 14 days from the date of being informed about it by the Partner will be equivalent to the Client's lack of acceptance of the offer to conclude a sales agreement.
16. W przypadku braku akceptacji przez Klienta oferty zawarcia umowy sprzedaży Urządzenia po cenie określonej Wyceną Ostateczną, Organizator odeśle Urządzenie Klientowi, a koszty wysyłki poniesie Organizator. W tej sytuacji Umowa Sprzedaży nie zostaje zawarta.
17. Wycena Wstępna ma charakter wyłącznie orientacyjny, a Wycena Ostateczna zostanie ustalona przez Organizatora po otrzymaniu Urządzenia i jego przetestowaniu. Organizator dokłada wszelkiej staranności, by zaproponować Klientowi korzystną kwotę za Urządzenie, jednakże ze względu na rodzaj i ilość uszkodzeń kwota ta może nie spełniać oczekiwań Klienta.
§ 5 Subject of the Agreement
The subject of the Sales Agreement under the terms specified in this Regulation is the Device, defined in sections 8 and 9 of this paragraph. The Device must be free from any legal defects and claims from third parties.
2. Klient ponosi odpowiedzialność za szkody wynikające z niezgodności z prawdą swoich oświadczeń i zwalnia Partnera oraz Organizatora od wszelkich roszczeń osób trzecich w związku z ich prawami odnośnie Urządzenia.
3. Poprzez wypełnienie Formularza Klient oświadcza, że jest jedynym właścicielem Urządzenia oraz że Urządzenie jest wolne od wad prawnych oraz zadłużeń finansowych takich jak np. raty, prawa osób trzecich oraz nie jest objęte zastawem.
In order to conclude a valid and binding sales agreement, the Client specifies the model and features of the Device they intend to sell. The Client fills out the Form, providing the necessary information to process the Submission, based on the messages displayed to the Client and the information available on the site as well as contained in these Terms and Conditions.
5. Podanie prawdziwych danych przez Klienta jest niezbędne do prawidłowej wyceny Urządzenia, za podanie nieprawdziwych danych odpowiada klient. Organizator jest uprawniony do odmowy zawarcia umowy sprzedaży albo do zmiany pierwotnie wykonanej Wyceny.
The ownership of the Device transfers to the Partner at the moment of payment for the Device in accordance with § 4 sec. 13.
The sale does not create any obligations on the part of the Partner regarding the conclusion or execution of mobile phone subscription agreements or other contractual obligations related to the Device.
A used phone or smartphone that may be the subject of a sales agreement between the Client and the Partner is considered to be one that:
1. włącza się i wyłącza,
is fully functional, works on all Polish networks,
has a functional display – the display does not have any dead pixels,
has a functional battery. A swollen battery is considered damaged,
5. nosi normalne ślady użytkowania, nie posiada wielkich lub głębokich rys, wgnieceń – nie nosi uszkodzeń mechanicznych,
6. nie był zalany cieczą,
7. posiada nr IMEI.
9. Organizator kupuje również Urządzenia uszkodzone (niespełniające warunków, o których mowa w ust. 8 powyżej) w następstwie indywidualnej wyceny.
10. W wypadku, kiedy okaże się, że w Zgłoszeniu podano inną markę lub model Urządzenia niż otrzymany przez Organizatora, Zgłoszenie zostanie skorygowane i przedstawione Klientowi razem z Wyceną Ostateczną przesłanego Urządzenia.
The amounts indicated by the Partner in the Preliminary Valuation are gross amounts as of the date the order is placed. Subsequent changes in the estimated prices of individual Devices on the Purchase page do not affect the value of the submitted Application for a period of 14 days from the date of its submission, as well as from the moment the Client sent the Device to the Partner.
12. W razie wątpliwości co do pochodzenia Urządzenia, Organizator może odmówić zakupu Urządzenia. Urządzenie, co do którego zachodzi uzasadnione podejrzenie, że pochodzi z czynu zabronionego (np. kradzież, przywłaszczenie )nie będzie akceptowane. O możliwości podejrzenia popełnienia przestępstwa Organizator będzie powiadamiał właściwe organy ścigania
13. Organizator jest uprawniony do weryfikacji numeru IMEI urządzenia objętego formularzem skupu w dostępnych bazach danych służących identyfikacji urządzeń utraconych, zablokowanych lub pochodzących z przestępstwa. W przypadku uzasadnionych wątpliwości co do legalnego pochodzenia Urządzenia Organizator może odmówić zawarcia Umowy Sprzedaży oraz podjąć działania wymagane przepisami prawa. Urządzenie nie może być objęte blokadą zarządzania urządzeniem (np. MDM, Find my iPhone, Factory Reset Protection (FRP) lub inne równoważne), blokadą operatora uniemożliwiającą jego normalne użytkowanie ani innymi zabezpieczeniami ograniczającymi możliwość korzystania z Urządzenia przez Organizatora w celu jego sprawdzenia. W razie wykrycia wskazanych wyżej ograniczeń Organizator może odpowiednio obniżyć Wycenę lub odmówić zawarcia Umowy Sprzedaży.
14. Przed wysłaniem Urządzenia Klient zobowiązany jest do wykonania kopii zapasowej wszystkich danych znajdujących się w Urządzeniu. Organizator nie ponosi odpowiedzialności za utratę danych wynikającą z czynności niezbędnych do przeprowadzenia diagnostyki, testów technicznych lub przywrócenia Urządzenia do ustawień fabrycznych.
15. Organizator nie ma obowiązku odzyskiwania danych ani podejmowania działań zmierzających do ich zachowania na Urządzeniu.
16. Przed wysłaniem Urządzenia Klient zobowiązany jest usunąć z Urządzenia wszystkie karty SIM, karty pamięci np. micro SD, a w razie ich pozostawienia w Urządzeniu Organizator nie ponosi za nie odpowiedzialności, w szczególności nie odpowiada za postawione na nich dane, nie ma obowiązku ich przechowywania ani odsyłania Klientowi. Pozostawione nośniki w razie zawarcia umowy sprzedaży mogą zostać zutylizowane i nie podlegają zwrotowi.
§ 6 Delivery and Return of the Device
The date of collection of the Device by the courier is specified by the Client while filling out the DHL form, for which the link was received in the email provided by the Organizer as a result of submitting the Form. In the DHL form, the Client indicates the registration number of the Device for Purchase provided by the Organizer in the aforementioned email..
The courier service is provided at the Organizer's expense – both in the case of the Client accepting the Final Quote and in the case of its rejection, resulting in the Partner returning the Device back to the Client.
In all cases, the Device should be packaged in a way that does not indicate the contents of the shipment and is adequately secured against any mechanical damage. The Client receives information on how to properly package the Device in the email mentioned in paragraph 1 above.
On the packaged shipment, the Client places the DHL label that they received in an email from the Organizer in response to submitting the Form.
5. Organizator odpowiada za przesyłkę od chwili jej wydania przewoźnikowi zgodnie z zasadami wynikającymi z przepisów prawa oraz regulaminu przewoźnika.
The return of the Device can only occur if the User does not accept the offer to enter into a sales agreement for the Device at the price determined by the Final Valuation within 14 days from the date the valuation was sent. In such a case, the return of the Device is at the Organizer's expense.
7. Jeżeli w toku weryfikacji okaże się, że przesłane Urządzenie różni się od danych podanych przez Klienta w Formularzu, w szczególności co do modelu, numeru IMEI, pojemności pamięci, koloru, stanu technicznego lub innych cech mających wpływ na wartość Urządzenia, Organizator dokona ponownej Wyceny Ostatecznej odpowiadającej rzeczywistym właściwościom Urządzenia. Klient zostanie poinformowany o nowej Wycenie Ostatecznej i będzie uprawniony do jej zaakceptowania albo odrzucenia na zasadach określonych w Regulaminie.
8. Jeżeli po otwarciu przesyłki okaże się, że nie zawiera ona zgłoszonego Urządzenia albo zawiera przedmiot inny niż wskazany w Formularzu, Organizator sporządzi dokumentację tego zdarzenia oraz poinformuje Klienta. W takim przypadku Organizator może odmówić zawarcia Umowy Sprzedaży, a dalsze postępowanie będzie prowadzone po wyjaśnieniu okoliczności zdarzenia. W przypadku uzasadnionego podejrzenia popełnienia przestępstwa Organizator może zawiadomić właściwe organy ścigania.
§ 7 Additional contractual provisions
During the testing of the Partner Device, it will restore the Device to factory settings, resulting in the loss of previously entered settings and data.
2. Do poprawnej wyceny stanu wizualnego wymagane jest usunięcie wszelkich zabezpieczeń ochronnych urządzenia np. naklejonych folii lub szkieł ochronnych, etui oraz innych akcesoriów.
3. Do Urządzeń Klient może dołączyć również akcesoria i pudełka, dołączenie akcesoriów jest dobrowolne i nie wpływa na wysokość Ostatecznej Wyceny Urządzenia.
4. Klient jest zobowiązany, we własnym zakresie, do usunięcia wszelkich osobistych danych dotyczących jego i ewentualnych poprzednich właścicieli (np. wpisy do książki adresowej, wiadomości, terminy w kalendarzu, zdjęcia, muzyka, gry, aplikacje) znajdujących się na wbudowanych bądź załączonych nośnikach danych, aby nie były one dostępne osobom trzecim. Partner ani Organizator nie ponoszą odpowiedzialności za poufność lub wykorzystanie tych danych. W przypadku pozostawienia na Urządzeniu lub jakimkolwiek nośniku używanym w Urządzeniu jakichkolwiek danych, zostaną one usunięte przez Organizatora wraz z przywróceniem Urządzenia do ustawień fabrycznych. Przesyłając Urządzenie do Organizatora, Klient zwalnia Partnera i Organizatora z wszystkich roszczeń wynikających ze szkody poniesionej w związku z usunięciem danych przechowywanych w Urządzeniu lub na dowolnym nośniku używanym w Urządzeniu.
The Partner is not liable for the non-performance or improper performance of any obligations arising from the agreement concluded through the Purchase, which is caused by force majeure.
§ 8 Conditions for Complaints
This Regulation provides for the possibility of submitting complaints by the Customers of the Purchase.
The basis for a complaint may be the non-performance of services for the Client within the framework of the Purchase or their execution in a manner inconsistent with the provisions of these Regulations.
3. Reklamację należy złożyć wysyłając taką informację na adres e-mail: skup@moby.pl ,w temacie wiadomości wpisując „Reklamacja – Skup telefonu” lub pocztą na adres wskazany w § 1 ust. 4, w terminie 14 dni od momentu zaistnienia podstawy reklamacji.
The complaint should be made in writing (or in the form of an email) and must include the reference number received in the email after submitting the Form, a contact email address, as well as a detailed description and reason for the complaint, along with the content of the request.
The Organizer contacts the Partner in situations where the reason for the complaint is related to actions for which the Partner is responsible under the Purchase Agreement and decides on the validity of the complaint.
6. Reklamacje rozpatruje Organizator.
The organizer, after receiving and recognizing the subject of the complaint, responds to the complaint within 14 calendar days from the date of its receipt. The response to the complaint is made by sending an email or a letter to the Client, depending on the method of communication chosen by the Client. The deadline for handling the complaint may be extended for justified reasons by the time necessary for its thorough consideration. The organizer will inform the Client about this using the method of communication chosen by the Client.
If the Partner considers the complaint justified, they will promptly take all necessary actions to prevent any grounds for complaints from arising in the future.
9. W przypadku uznania reklamacji za bezzasadną Organizator poinformuje Klienta o tym rozstrzygnięciu wraz z jego uzasadnieniem. Za bezzasadną uznaje się m.in. taką reklamację, której podstawą, w ocenie Klienta, są nieprawidłowe działania Organizatora, podejmowane jednak na skutek nieprawidłowego zachowania/korzystania ze strony https://www.hammerphones.com/phone-buyback przez Klienta, do których w rzeczywistości Organizator jest uprawniony.
§ 10 Processing of Personal Data by the Partner
The administrator of personal data of Clients is the company mPTech Sp. z o. o. based in Warsaw (00-511) at 31 Nowogrodzka Street, registered in the business register of the National Court Register maintained by the District Court for the capital city of Warsaw in Warsaw, XII Economic Division of the National Court Register under the number 0000243245, NIP 8951845043, REGON 020167256.
The personal data of Clients of the Buyback will be processed in order to carry out the necessary actions to fulfill the Submission within the Buyback, including communicating with Clients, transferring the Device, as well as addressing any potential complaints, based on Article 6(1)(f) (legitimate interest of the Organizer) of the Regulation of the European Parliament and of the Council (EU) 2016/679 of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter referred to as "GDPR").
3. W związku ze Skupem przetwarzane będą następujące dane osobowe Klientów: imię, nazwisko, numer telefonu, adres e-mail, adres zamieszkania lub adres korespondencyjny, numer konta bankowego (dane zamieszczone przez Klienta w Formularzu, korespondencji z Organizatorem i/ lub Partnerem oraz w ewentualnej reklamacji).
Providing personal data is voluntary; however, it is necessary to participate in the Purchase.
Personal data will be stored until the communication with the Partner is completed for the purpose of concluding the Agreement, executing the bank transfer, and providing the discount code by the Organizer, as well as for the purpose of protecting the rights of the Organizer and defending against claims, for no longer than the statute of limitations for claims.
The client has the right to access the content of their data and to rectify, delete, restrict processing, transfer, object to processing, and withdraw consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
The data will not be transferred to a third country or international organization, nor will it be subjected to profiling.
Customer personal data may be transferred to entities providing accounting, legal, advisory, and courier services for the Organizer. Customer personal data will also be transferred to the Partner – the rules for processing personal data by the Partner are specified in § 10 below.

10. W przypadku uznania, iż przetwarzanie przez Organizatora danych osobowych Klientów narusza przepisy RODO, Klientowi przysługuje prawo do wniesienia skargi do organu nadzorczego tj. do Prezesa Urzędu Ochrony Danych Osobowych.
11. Organizator i Partner są współadministratorami.
§ 9 Processing of Personal Data by the Organizer
The data controller for the personal data of Clients is also Moby.pl sp. z o.o. based in Wrocław at ul. Jana Długosza 68, 51-162 Wrocław, registered in the District Court for Wrocław-Fabryczna, VI Economic Division KRS: 0000435984, with a share capital of 5,000 PLN, REGON: 021986625, NIP: 898-220-16-48.
2. Dane osobowe Klientów Skupu będą przetwarzane w celu przeprowadzenia czynności niezbędnych do realizacji Zgłoszenia i zawarcia umowy sprzedaży w ramach Skupu, w tym komunikowania się z Klientami, testowania Urządzenia, a także rozpatrzenia ewentualnych reklamacji, na podstawie art. 6 ust. 1 lit. b (czynności niezbędne do zawarcia umowy) oraz w zakresie dochodzenia i obrony przed roszczeniami – lit. f. Rozporządzenia Parlamentu Europejskiego i Rady (UE) 2016/679 z dnia 27 kwietnia 2016 r. w sprawie ochrony osób fizycznych w związku z przetwarzaniem danych osobowych i w sprawie swobodnego przepływu takich danych oraz uchylenia dyrektywy 95/46/WE (ogólne rozporządzenie o ochronie danych, dalej jako „RODO”).
3. W związku ze Skupem przetwarzane będą następujące dane osobowe Klientów: imię, nazwisko, numer telefonu, adres e-mail, adres zamieszkania lub adres korespondencyjny, numer konta bankowego (dane zamieszczone przez Klienta w Formularzu, korespondencji z Organizatorem i / lub Partnerem oraz w ewentualnej reklamacji).

If it is determined that the Organizer's processing of Customers' personal data violates the provisions of the GDPR, the Customer has the right to file a complaint with the supervisory authority, namely the President of the Personal Data Protection Office.
§ 11 Final Provisions

In all matters not regulated by these Regulations, the provisions of Polish law shall apply, in particular the Civil Code.
Participation in the Purchase means the Client's acceptance of the provisions of the Regulations.
5. Organizator ma prawo do zmiany postanowień niniejszego Regulaminu, o ile nie wpłynie to na pogorszenie warunków uczestnictwa w Skupie dla dotychczasowych Klientów, którzy dokonali Zgłoszeń (ich zgłoszenia będą rozpatrywane na podstawie Regulaminu obowiązującego w dacie zgłoszenia z zastrzeżeniem ust.7). Dotyczy to w szczególności zmian terminów trwania programu. Zmieniony Regulamin obowiązuje od czasu opublikowania go na stronie https://www.hammerphones.com/regulamin-skupu-telefonow.
6. Organizator i Partner zastrzegają sobie prawo zmiany cen Urządzeń wskazanych na stronie https://www.hammerphones.com/phone-buyback.
In the event of a change in the price list or Terms and Conditions during the process leading to the conclusion of the Sales Agreement, the prices and provisions of the Terms and Conditions prior to the change shall apply. The new price should be applied if the Customer does not ship the Device after 14 days or does not hand over the phone to the courier, and the price changes during that time.
